ACCEPTANCE AND ACKNOWLEDGEMENT
Definitions
In the context of this Hire-A-Contractor-Now agreement (and/or the terms and conditions) the meaning of the following words shall imply as mentioned against it.
Buyer
shall mean homeowners, individuals, institutions, or other property owners who are in complete legal and physical possession of a home or other buildings upon or in which the task is to be undertaken, and who are registered or subscribed with Hire-A-Contractor-Now.com
Seller
shall mean individual contractors, builders, contracting companies, or group of contractors who are in possession of necessary certificates, experience, licenses or any other documents as applicable to federal, state, provincial and local laws for undertaking contract works and who are registered or subscribed with Hire-A-Contractor-Now.com ‘You’, ‘Member’, ‘Your’ shall mean ‘Buyers’, ‘Sellers’ and/or both ‘Buyers’ and ‘Sellers’ of Hire-A-Contractor-Now .com
‘Hire-A-Contractor-Now’, ‘Hire-A-Contractor-Now’, ‘we’, ‘us’, ‘our’ shall mean Hire-A-Contractor-Now.com
‘Project’ shall mean all works intended by buyers such as development of a new home or building, re-modeling existing structures, repairs, maintenance or any other home or building service requirements.
‘Bid’ shall mean willingness by the seller to undertake or execute a buyer’s project subject to the seller’s own terms and conditions.
‘PayPal System’ shall mean the online system operated by PayPal, Inc. that enables any individual or business with an email address to send and receive payments online.
Services
Hire-A-Contractor-Now offers services to both buyers and sellers.
Services to buyers
Hire-A-Contractor-Now allows buyers to post in Hire-A-Contractor-Now website their home or other building improvement needs, whether new development, re-modeling existing structures, repairs, maintenance or any other home or building service requirements along with a photo.
Buyers are also provided access to specific or restricted information available with Hire-A-Contractor-Now about the sellers.
These services are provided free to buyers.
Once buyers post their project, Hire-A-Contractor-Now intends to provide a list of sellers along with their past experience, certifications, licenses, portfolio, profile (as and if provided by the sellers) along with comments and feedbacks from previous buyers (as and if provided by the buyers).
Buyers’ projects are made accessible for sellers so as to enable sellers to bid for the projects.
Through this, Hire-A-Contractor-Now intends to provide buyers a competitive virtual market to post their project for multiple sellers to bid and thereby intends to assist buyers to find a best contractor.
Hire-A-Contractor-Now also offers support to the buyers by providing private email accounts with specific features that enable buyers to monitor bids and communicate with sellers directly.
Services for sellers
Hire-A-Contractor-Now allows sellers to be listed in Hire-A-Contractor-Now, subject to the condition that sellers subscribe to any one of the four plans offered by Hire-A-Contractor-Now and subject to the payment and confirmation of subscription fees as applicable for each plan by the seller.
These plans are:
(a) Economy Plan
As per Hire-A-Contractor-Now’s Economy plan, sellers are allowed to bid for a maximum of 100 projects for which the subscription fee is priced at $ 70 per month; $150 for quarterly subscription and $500 for yearly subscription.
Additionally, a service fee of $3 for each bid over and above 100 projects is to be paid to Hire-A-Contractor-Now by the seller.
(b) Professional
Plan As per Hire-A-Contractor-Now.coms Professional Plan, sellers are allowed to bid for a maximum 150 projects and the subscription fee is priced at $ 100 for a month;$250 for quarterly subscription and $800 for yearly subscription.
Additionally, a service fee of $3 for each bid over and above 150 projects is to be paid to Hire-A-Contractor-Now.com by the seller.
(c) Project-to-Project Plan
As per Hire-A-Contractor-Now.com Project-to-Project Plan, a fee of $ 5 per bid is to be paid to Hire-A-Contractor-Now.com by the seller.
(d) Contractor Information Add Plan
Hire-A-Contractor-Now.com Contractor Information Add Plan allows sellers to view the listing of buyers’ details and other sellers’ details, but restricts from participating the bidding process. As per this plan, either a monthly subscription fee of $25 or a yearly subscription fee of $150 is to be paid to Hire-A-Contractor-Now.com by the seller.
According to the seller’s subscription plan, Hire-A-Contractor-Now.com provides sellers access to specific or restricted information available with Hire-A-Contractor-Now.com about the buyers and their project details. Sellers are allowed to bid for projects including multiple projects as per their subscription plan.
Service charges
By agreeing to subscribe to Hire-A-Contractor-Now.com, the seller explicitly accepts to a service charge of 0.6% on the total bid value of the project(s) which is payable to Hire-A-Contractor-Now.com upon award and/or successful bidding of a project and/or multiple projects.
Sellers must make payment of service charge to Hire-A-Contractor-Now.com after three weeks from the date of acceptance of the invoice by the buyer.
This service charge is over and above the subscription charges applicable under the Hire-A-Contractor-Now.com plans [as mentioned in para.2 (ii) above].
Limitation in Services
Hire-A-Contractor-Now.com assists buyers [as mentioned in para.2 (i)] in finding a best seller but do not guarantee buyers to identify a best seller.
Hire-A-Contractor-Now.com assists seller [as mentioned in para.2 (ii)] in award of projects but do not guarantee sellers award of the buyers’ project.
Hire-A-Contractor-Now.com does not endorse or recommend the services of any particular seller nor does it endorse or recommend projects of any particular buyer.
Hire-A-Contractor-Now.com provides only a virtual market where buyers and sellers can identify each other. It is entirely up to the buyers and sellers to enter into a direct contract or reach an agreement and Hire-A-Contractor-Now.com does not guarantee or warrant the project of the buyer or the performance or service or quality of the seller.
The contract or agreement entered into by both buyers and sellers are governed by the terms of such contracts or agreements and are applicable to federal, state, provincial and local laws.
Hire-A-Contractor-Now.com does not perform, and is not responsible for any other services requested by the buyer or seller apart from those explicitly contained in this agreement.
Hire-A-Contractor-Now.com takes certain steps to verify the credentials of the sellers such as their experience, profile, portfolio, certifications or licenses, but do not make guarantee or substantiate their claims nor their performance or quality of service rendered or to be rendered. If a dispute arises between a buyer and a seller, then they must address such dispute with each other directly.
The buyer and the seller hereby agree to release Hire-A-Contractor-Now.com(and its officers, directors, affiliates, employees and agents) and any other person, firm, or entity (including its business partners such as a product manufacturer or supplier who may employ the Hire-A-Contractor-Now.com matching utility) from any damages or claims (including consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and their dealings with each other.
Relationship
Buyers and sellers are not partners, employees or agents of Hire-A-Contractor-Now.com, nor is Hire A Contractor-now.com partner, employee or an agent of the buyers and sellers.
Payment
Hire-A-Contractor-Now.com receives payments such as subscription fees and other service charges through PayPal system only. Since payment is made through PayPal system, information relating to your financial transactions is passed on to PayPal.com.
Hire-A-Contractor-Now.com doesn’t collect, store or access these details.

Payments once received will not be refunded under what so ever circumstances or situations.
You hereunder explicitly agree not to request for refund of subscription fees and or other service charges.
Indemnification
You agree to indemnify, and hold harmless Hire-A-Contractor-Now.com, its advertisers, subsidiaries, other affiliated companies, employees, contractors, officers, co-branders, agents and directors from all liabilities, demands, claims, and expenses, including attorney's fees, that arise from your use of this site, or any services, or information, or your violation of these terms and conditions set forth in this Hire-A-Contractor-Now.com agreement or arising from your violation of any rights of a third party.
Privacy of Information
You will be prompted to divulge certain information about yourselves, your service requirements, your activities both past and present, and/or other information relevant to the context of Hire-A-Contractor-Now.com services, in order to become a member and to avail Hire-A-Contractor-Now.com services. We in the process of servicing your requirement shall store and/or make available fully or partly your information in our website.
Hire-A-Contractor-Now.com also transmits your information fully or partly to its advertisers, subsidiaries, other affiliated companies and/or websites, employees, contractors, officers, co-branders, agents and or directors and to other members of Hire-A-Contractor-Now.com to enable us to serve your requirement.

Your Responsibilities
Upon becoming a member of Hire-A-Contractor-Now.com, a separate private account will be created for you by Hire-A-Contractor-Now.com and you will be provided with a username and a password to access it. You must make sure that your username and password remains confidential at all times and you hereby agree that you are entirely responsible for all activities which occur under your username and password, including unauthorised use by persons to whom you intentionally or negligently allowed access to your account.
You assure that all information provided by you will be accurate, up-to-date, genuine and truthful to the best of your knowledge. If the information provided by you is not genuine, out-dated and/or incomplete, or if Hire-A-Contractor-Now.com has reasonable grounds to suspect that such information is inaccurate, not genuine, out-dated and/or incomplete, Hire-A-Contractor-Now.com has the right to refuse any use, either partly or fully of the Hire-A-Contractor-Now.com services, by you.

If any provision of this Agreement is prohibited by law or held to be unenforceable, the remaining provisions hereof shall not be affected, and this Agreement as much as possible under applicable law shall continue in full force and effect as if such unenforceable provision had never constituted a part hereof and the unenforceable provision shall be automatically amended to so as to best accomplish the objectives of such unenforceable provision within the limits of applicable law. You agree that you will not assign or transfer this Agreement and any such transfer shall be void.
(i) Liability
Under no circumstances shall the Hire-A-Contractor-Now.com, advertisers and/or its licensors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from, or arise out of the use of, or inability to use, the site, the information contained on or received through use of this site, or any services or products received through this site.
